SHIPPING & DELIVERY POLICY
This Shipping & Delivery Policy is part of our Terms and Conditions ("Terms") and should be therefore read alongside our main Terms. Please carefully review our Shipping & Delivery Policy when purchasing our products. This policy will apply to any order you place with us.
By using the site and/or ordering, you are agreeing to this shipping & delivery policy without exception. If you do not agree, and you have already placed an order, then you must contact us to cancel and refund that order prior to us shipping.
Order processing time:All orders are picked, packed, and processed for carrier pickup within 48 business hours (excluding weekends and holidays) after placing your order (the order date & time is automatically captured by our ecommerce software, Shopify, and is always considered the reference time).
Carrier pickups:Orders that have been picked, packed, and processed will then be picked up at our fulfillment center by the carrier(s) within one (1) business day (excluding weekends and holidays).
Order/Shipping notifications:You will receive an order confirmation email once your order has been successfully placed. You will receive a second email notification when your order has been picked, packed, and processed and is ready for carrier pickup. All times and dates given for delivery of the products are given in good faith but are estimates only. Unless specifically noted, estimated delivery times reflect the earliest available delivery, and deliveries will be made within 30 days after the day we accept your order. If delivery is delayed for any reason we will let you know as soon as possible and will advise you of a revised estimated date for delivery. For EU and UK consumers: This does not affect your statutory rights.
Shipping rates:Shipping charges for your order will be calculated, displayed, and collected at checkout. We will honor this charge when paid, even if the actual shipping rate Balance It® is later charged is greater when your order is shipped.
Carrier transit times:Balance It® does not guarantee the carrier transit times that are estimated and displayed at checkout. These carrier estimated transit times are generated through an application programming interface (API) provided by each individual carrier. Actual carrier transit times, and therefore order delivery times, may vary. Please consult the carriers' websites directly for the most up-to-date information about these services and any delays or disruptions they may be experiencing.
Import duties and taxes (including VAT):Your order may be subject to import duties and taxes (including VAT). Some, but not all of these may be calculated, displayed, and collected at checkout and reported on your international invoice. However, there are times when additional charges may be assessed/incurred once a shipment reaches your destination country. Balance It® is not responsible for these additional duties and/or taxes if they are applied and are your responsibility to pay as the customer.
Incorrect address/Address correction:You are responsible for any errors in shipping addresses entered by you. This includes errors of omission like apartment, unit, and suite numbers, phone number, or incorrect Zip or postal codes. If you are unsure of your address, please check with your postal carrier, UPS, FedEx, and/or DHL to determine what your delivery address is. If we cannot ship your order due to an incorrect/incomplete address (including phone number), the 48 business hour processing time commitment listed above is voided. You will be contacted by our customer service team via phone and/or email to correct the issue. We will then process your order within 48 business hours of receiving the corrected address. If we do not receive a corrected shipping address within 2 business days of reaching out to you, your order will be canceled and refunded to the credit card used for the order.
Address correction charges:If an order is shipped, and it is later determined by the carrier that the address was incorrect due to an error on your part, all address correction fees or return to sender fees assessed to Balance It® from the carrier(s) will be forwarded and charged to your account/deducted from any future refund(s).
Refusing delivery/Return to sender:If you refuse delivery of your order, and/or instruct the carrier to “return to sender", all return to sender fees assessed to Balance It® from the carrier(s) will be forwarded and charged to your account/deducted from any future refund(s). The average fee is $17, but may be higher (especially for any international orders or if more than 1 bag or many pouches).
P.O. boxes:We can only ship to P.O. Boxes within the United States via the United States Postal Service (USPS). We cannot ship to P.O. Boxes located outside of the United States.
Military mail:We can only ship to APO or FPO (Military) P.O. boxes via the United States Postal Service (USPS).
International shipment options:We offer international shipping to many countries although some restrictions may apply due to world events like war, natural disasters, economic sanctions, or pandemics. If the country you wish to ship to is not listed as an option at check out, then we cannot currently ship there. If you have additional questions about a specific country, please contact us at info@balanceit.com.
Carrier claims:If you feel your order was not delivered per the policy of the chosen carrier (e.g., late, damaged, misdelivered), we will initiate a claim on your behalf with the carrier via their designated claims process. Please email info@balanceit.com with the details supporting your claim (including pictures of all sides of packaging and products received if a damage claim). Refunds will only be given if the claim is settled in your favor and provided to us directly by the carrier. The carrier claims process, including the speed and amount of any decision/resolution, is controlled by the carrier and not Balance It®.
Balance It® processing time claims:If you feel that your order was not processed within 48 business hours per our policy, please email customer service at info@balanceit.com with the details supporting your claim (e.g., email notifications).
Product expiration dates:All orders will be fulfilled with products that will have no less than 3 months and no more than 11 months of shelf life (time before expiration) at the time of shipping.
COOKIE POLICY
This Cookie Policy last updated on April 3, 2023 explains how Davis Veterinary Medical (DVM) Consulting, Inc. ("Company", "we", "us", and "our") uses cookies and similar technologies to recognize you when you visit our websites at https://balance.it, balan.ce.it, balanceit.com, balanceit.co, balanceddiet.com, petfoodrecipes.com, vet.recipes, & vetnutritionist.com ("Websites"). It explains what these technologies are and why we use them, as well as your rights to control our use of them.
In some cases we may use cookies to collect personal information, or that becomes personal information if we combine it with other information.
What are cookies?
Cookies are small data files that are placed on your computer or mobile device when you visit a website. Cookies are widely used by website owners in order to make their websites work, or to work more efficiently, as well as to provide reporting information.
Cookies set by the website owner (in this case, Davis Veterinary Medical Consulting, Inc.) are called "first-party cookies". Cookies set by parties other than the website owner are called "third-party cookies". Third-party cookies enable third-party features or functionality to be provided on or through the website (e.g., like advertising, interactive content and analytics). The parties that set these third-party cookies can recognize your computer both when it visits the website in question and also when it visits certain other websites.
Why do we use cookies?
We use first- and third-party cookies for several reasons. Some cookies are required for technical reasons in order for our Websites to operate, and we refer to these as “essential" or “strictly necessary" cookies. Other cookies also enable us to track and target the interests of our users to enhance the experience on our online properties. Third parties serve cookies through our Websites for advertising, analytics and other purposes. This is described in more detail below.
The specific types of first- and third-party cookies served through our Websites and the purposes they perform can be found on the table at https://balance.it/r/cookies (please note that the specific cookies served may vary depending on the specific online properties you visit).
How can I control cookies?
You have the right to decide whether to accept or reject cookies. You can exercise your cookie rights by setting your preferences in your browser. You can accept or reject certain cookies depending on your browser’s features. As the means by which you can refuse cookies through your web browser controls vary from browser-to-browser, you should visit your browser's help menu for more information (pages like this https://www.cookiepro.com/knowledge/how-to-manage-cookies-by-browser/ may also be helpful). Essential cookies cannot be rejected as they are strictly necessary to provide you with services.
If you choose to reject cookies, you may still use our website though your access to some functionality and areas of our website may be restricted.
In addition, most advertising networks offer you a way to opt out of targeted advertising. If you would like to find out more information, please visit http://www.aboutads.info/choices/ or http://www.youronlinechoices.com.
What about other tracking technologies, like web beacons?
Cookies are not the only way to recognize or track visitors to a website. We may use other, similar technologies from time to time, like web beacons (sometimes called "tracking pixels" or "clear gifs"). These are tiny graphics files that contain a unique identifier that enable us to recognize when someone has visited our Websites or opened an e-mail including them. This allows us, for example, to monitor the traffic patterns of users from one page within a website to another, to deliver or communicate with cookies, to understand whether you have come to the website from an online advertisement displayed on a third-party website, to improve site performance, and to measure the success of any email marketing campaigns. In many instances, these technologies are reliant on cookies to function properly, and so declining cookies will impair their functioning.
Do you serve targeted advertising?
Third parties may serve cookies on your computer or mobile device to serve advertising through our Websites. These companies may use information about your visits to our Website and other websites in order to provide relevant advertisements about goods and services that you may be interested in. They may also employ technology that is used to measure the effectiveness of advertisements. This can be accomplished by them using cookies or web beacons to collect information about your visits to this and other sites in order to provide relevant advertisements about goods and services of potential interest to you. The information collected through this process does not enable us or them to identify your name, contact details or other details that directly identify you unless you choose to provide these.
How often will you update this Cookie Policy?
We may update this Cookie Policy from time to time in order to reflect, for example, changes to the cookies we use or for other operational, legal or regulatory reasons. Please therefore re-visit this Cookie Policy regularly to stay informed about our use of cookies and related technologies.
The date at the top of this Cookie Policy indicates when it was last updated.
Where can I get further information?

18. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) NOTICE AND POLICY
Notifications
We respect the intellectual property rights of others. If you believe that any material available on or through the Site infringes upon any copyright you own or control, please immediately notify our Designated Copyright Agent using the contact information provided below (a “Notification"). A copy of your Notification will be sent to the person who posted or stored the material addressed in the Notification. Please be advised that pursuant to United States federal law you may be held liable for damages if you make material misrepresentations in a Notification. Thus, if you are not sure that material located on or linked to by the Site infringes your copyright, you should consider first contacting an attorney.
All Notifications should meet the requirements of DMCA 17 U.S.C. § 512(c)(3) and include the following information: (1) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (2) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on the Site are covered by the Notification, a representative list of such works on the Site; (3) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; (4) information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted; (5) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (6) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed upon.
Counter Notification
If you believe your own copyrighted material has been removed from the Site as a result of a mistake or misidentification, you may submit a written counter notification to us/our Designated Copyright Agent using the contact information provided below (a “Counter Notification"). To be an effective Counter Notification under the DMCA, your Counter Notification must include substantially the following: (1) identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled; (2) a statement that you consent to the jurisdiction of the United States Federal District Court in which your address is located, or if your address is outside the United States, for any judicial district in which we are located; (3) a statement that you will accept service of process from the party that filed the Notification or the party's agent; (4) your name, address, and telephone number; (5) a statement under penalty of perjury that you have a good faith belief that the material in question was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled; and (6) your physical or electronic signature.
If you send us a valid, written Counter Notification meeting the requirements described above, we will restore your removed or disabled material, unless we first receive notice from the party filing the Notification informing us that such party has filed a court action to restrain you from engaging in infringing activity related to the material in question. Please note that if you materially misrepresent that the disabled or removed content was removed by mistake or misidentification, you may be liable for damages, including costs and attorney's fees. Filing a false Counter Notification constitutes perjury.

19. TERM AND TERMINATION
These Terms of Use shall remain in full force and effect while you use the Site. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF USE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE AND THE MARKETPLACE OFFERINGS (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF USE OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SITE AND THE MARKETPLACE OFFERINGS OR DELETE YOUR ACCOUNT AND ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.
If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
20. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Marketplace Offerings without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site or the Marketplace Offerings.
We cannot guarantee the Site and the Marketplace Offerings will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site or the Marketplace Offerings at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site or the Marketplace Offerings during any downtime or discontinuance of the Site or the Marketplace Offerings. Nothing in these Terms of Use will be construed to obligate us to maintain and support the Site or the Marketplace Offerings or to supply any corrections, updates, or releases in connection therewith.
21. GOVERNING LAW
These Terms of Use and your use of the Site and the Marketplace Offerings are governed by and construed in accordance with the laws of the State of California applicable to agreements made and to be entirely performed within the State of California, without regard to its conflict of law principles.
22. DISPUTE RESOLUTION
Informal Negotiations
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms of Use (each "Dispute" and collectively, the “Disputes") brought by either you or us (individually, a “Party" and collectively, the “Parties"), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.
Binding Arbitration
If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute (except those Disputes expressly excluded below) will be finally and exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA") and, where appropriate, the AAA’s Supplementary Procedures for Consumer Related Disputes ("AAA Consumer Rules"), both of which are available at the AAA website www.adr.org. Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Consumer Rules and, where appropriate, limited by the AAA Consumer Rules. The arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator will make a decision in writing, but need not provide a statement of reasons unless requested by either Party. The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so. Except where otherwise required by the applicable AAA rules or applicable law, the arbitration will take place in Yolo County, California. Except as otherwise provided herein, the Parties may litigate in court to compel arbitration, stay proceedings pending arbitration, or to confirm, modify, vacate, or enter judgment on the award entered by the arbitrator.
If for any reason, a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the state and federal courts located in Yolo or Sacramento Counties, California, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction, and forum non conveniens with respect to venue and jurisdiction in such state and federal courts. Application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded from these Terms of Use.
In no event shall any Dispute brought by either Party related in any way to the Site be commenced more than one (1) year after the cause of action arose. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.
Restrictions
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions to Informal Negotiations and Arbitration
The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief.
